Agreement
These Terms + Conditions (“Terms”) are an agreement between you and Laguna Foundry, the company behind Worker Websites (“Worker Websites,” “we,” “us,” or “our”). By accessing workerwebsites.com, using its public features, or requesting a demo, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the site. If you use the site for a company, you represent that you have authority to bind that company.
What these terms cover
These Terms cover the public website, service descriptions, demo scheduler, and related communications. They do not replace a proposal, order form, statement of work, subscription agreement, or other signed customer agreement. If a signed agreement conflicts with these Terms, the signed agreement controls for the paid services it covers.
Who may use the site
You must be at least 18 years old and legally able to enter a contract. Worker Websites is offered for business use. You may not use the site if doing so would violate applicable law or a binding obligation you owe to someone else.
Website information
We try to keep the site accurate and useful, but public website content is general information—not legal, tax, accounting, or compliance advice. Features, pricing, availability, timelines, and service descriptions may change. A quote or signed agreement is the final word on what we will provide and what it will cost.
We do not promise search rankings, leads, booked jobs, revenue, or any other business result. Results depend on your market, competition, budget, responsiveness, reputation, offer, and the work you do after a customer reaches out.
Demo requests and messages
When you submit a booking or inquiry, you agree that we may contact you about that request by phone, email, or text. Consent to receive marketing messages is separate, is not a condition of purchase, and may be withdrawn at any time.
Message and data rates may apply. You can reply STOP to a text to opt out of further texts from that number. We may send a non-marketing confirmation of the opt-out. Do not submit a phone number or email address you are not authorized to use.
Paid services
Paid services begin only after the parties approve the applicable written agreement. That agreement will address scope, fees, billing, payment timing, revisions, launch requirements, usage charges, cancellation, ownership, and support. You are responsible for reviewing and approving your business facts, claims, pricing, licenses, service areas, and customer communication rules before launch.
Your materials
If you send us logos, photos, copy, customer lists, reviews, contact data, or other materials, you represent that you have the rights and permissions needed for us to use them for your request or service. You keep ownership of your materials and grant us a limited license to host, reproduce, adapt, and use them only as needed to provide the requested work.
You are responsible for the accuracy and legality of your materials and for obtaining any required consent before providing personal information to us or using calls, texts, email, review requests, advertising, or other marketing tools.
Acceptable use
You may not use the site to:
- break the law, infringe rights, or misrepresent your identity;
- submit malicious code, scrape at unreasonable volume, or probe security;
- interfere with the site, its hosting, or another person’s use;
- send spam, unlawful calls or texts, or deceptive review requests;
- copy or republish substantial site content as your own; or
- use our name, marks, or work to imply an endorsement we did not give.
We may block access or decline a request when we reasonably believe misuse is occurring.
Our intellectual property
The site’s design, copy, brand, logos, graphics, code, and other content are owned by Laguna Foundry or used with permission. These Terms give you a limited, revocable right to view and use the public site for legitimate business evaluation. They do not transfer ownership or grant a license to reuse Worker Websites or Laguna Foundry branding.
Third-party services
The site may load or link to services operated by other companies, including scheduling, CRM, communications, hosting, maps, advertising, or social platforms. Their services have their own terms and privacy practices. We are not responsible for third-party services we do not control, although we choose vendors with the practical needs of the service in mind.
Disclaimers
To the fullest extent allowed by law, the public site is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will always be uninterrupted, error-free, secure, or free of harmful components. Some jurisdictions do not allow certain disclaimers, so part of this section may not apply to you.
Limitation of liability
To the fullest extent allowed by law, Laguna Foundry and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the public site.
Our total liability arising from the public site will not exceed the greater of $100 or the amount you paid us specifically for use of the public site during the 12 months before the event giving rise to the claim. A signed customer agreement may state a different limit for paid services.
Indemnity
You agree to defend, indemnify, and hold harmless Laguna Foundry and its owners, employees, contractors, and affiliates from third-party claims, losses, and reasonable costs arising from your unlawful use of the site, your violation of these Terms, or materials you submit without the required rights or permissions.
General terms
California law governs these Terms without regard to conflict-of-law rules. Any dispute concerning only the public site must be brought in the state or federal courts located in Orange County, California, unless applicable law requires otherwise.
If one provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, reorganization, sale, or transfer of the business.
